Slovenia Real Estate Consumer Notice

1. Purpose of This Notice

This notice, issued by Investra International Ltd, 128 City Road, London EC1V 2NX, United Kingdom, summarises consumer-relevant rules applying to residential real-estate transactions in the Republic of Slovenia presented through the Investra platform. It is general information, not legal advice, and supplements the General Terms of Use and the Booking Terms.

2. Real Estate Agency Services

Brokerage in Slovenia is regulated by the Real Estate Agencies Act (Zakon o nepremičninskem posredovanju, ZNPosr). Agency services for a consumer may only be provided under a written brokerage agreement, and the broker's commission for the sale of residential property is capped by law (currently at 4% of the contract price, shared as agreed between the parties).

Listings on the Platform identify the licensed local agency responsible for brokerage where Investra is not itself providing the service.

3. Mandatory Disclosures

Sellers and brokers must disclose material information before contract, including: the legal status of the property in the Land Register (zemljiška knjiga); registered encumbrances, easements and pre-emption rights; the energy performance certificate (energetska izkaznica), which is mandatory for marketing and sale; and known material defects.

Buyers should always obtain a current Land Register extract; the Platform links to the official e-Sodstvo portal where available.

4. Form of Contract and Notarisation

A contract for the transfer of immovable property must be in writing, and the seller's signature on the registrable deed (zemljiškoknjižno dovolilo) must be notarised. Registration of ownership in the Land Register is constitutive: ownership passes only upon entry.

5. Pre-emption Rights

Statutory pre-emption rights may apply, including in favour of co-owners, municipalities in defined areas, and tenants in specific cases. The transaction timeline in a Listing accounts for applicable waiting periods where these rights must be offered.

6. Taxes and Costs

Typical costs include real-estate transfer tax of 2% (or VAT for new buildings sold by taxable persons, in which case transfer tax does not apply), notary fees, court registration fees and any agreed brokerage commission. Capital-gains tax may apply to the seller and does not affect the buyer's title.

Figures are indicative and subject to change; a cost summary is shown per Listing before reservation.

7. Consumer Protection and Withdrawal

Slovenian consumer-protection law (ZVPot-1) applies to services provided to consumers, alongside the EU-derived rights described in the Cancellation & Refund Policy. Rights concerning the property purchase contract itself are governed by the Code of Obligations and cannot be limited by the Platform's terms.

8. Language and Dispute Resolution

Contractual documents for consumers in Slovenia are made available in Slovene where required by law. Complaints may be raised under the Complaints & Dispute Policy; consumers may also approach the Slovenian market inspectorate or a certified ADR body.
